| dc.description.abstract | Introdução: Apresenta um estudo sobre o induzimento, instigação e auxílio ao suicídio no campo virtual. A ideação ao suicídio pela internet caracteriza ilícito penal, sendo a vítima induzida, instigada ou auxiliada para a realização do ato. Objetivo: Demonstrar a forma como é praticado o crime tipificado no artigo 122 do Código Penal Brasileiro quando pelos meios de comunicação e a falta de regulamentação específica passíveis de punir e responsabilizar os envolvidos. Sendo o estudo relevante para frisar que a tutela jurisdicional atualmente possível de ser exercida quanto ao crime praticado pela internet não é efetiva, reforçando a necessidade de reformar as leis já existentes para a real concretização da punição. Metodologia: O método utilizado foi uma revisão de literatura, realizado pelo levantamento de artigos em bancos de dados online, manuais oficiais disponibilizados pela Organização Mundial da Saúde e pela Organização Pan Americana da Saúde, livros sobre o assunto, notícias relacionadas ao tema e na legislação vigente. Resultados: Verificou-se a possibilidade de tipicidade do crime de induzimento, instigação e auxílio ao suicídio pelos meios virtuais e que apesar do tema ter sido altamente debatido, ainda carece de atenção e regulamentação. Conclusão: Este estudo permitiu demonstrar que apesar de ser crime típico e dos esforços empregados pelos legisladores na elaboração de projetos leis, os agentes que incidem nesses crimes ainda permanecem sem punição. | en_US |
| dc.description.edition | Introduction: It presents a study about the induction, instigation and aid to the suicide in the virtual field. The ideation of suicide over the internet characterizes criminal offense, being the victim induced, instigated or assisted to perform the act. Objective: To demonstrate how the crime typified in article 122 of the Brazilian Penal Code is committed when through the media and the lack of specific regulation that can punish and hold those involved responsible. The study is relevant to emphasize that the judicial protection currently possible to be exercised over the crime committed by the Internet is not effective, reinforcing the need to reform the existing laws for the real implementation of the punishment. Methodology: The method used was a literature review, conducted by collecting articles in online databases, official manuals available from the World Health Organization and the Pan American Health Organization, books on the subject, news related to the topic and legislation. in force. Results: It was verified the possibility of typicality of the crime of induction, instigation and aid to suicide by the virtual means and that although the subject has been highly debated, still needs attention and regulation. Conclusion: This study showed that, despite being a typical crime and the efforts made by legislators in drafting laws, the agents that focus on these crimes still remain unpunished. | en_US |
