| dc.description.abstract | Introdução: Traz um estudo sobre o problema relacionado com o tráfico de animais silvestres e a biopirataria. Objetivo: Apresentar uma fazer uma análise acerca do tráfico de animais silvestres, conjugado com outros problemas, que é a biopirataria e a (in)eficácia da legislação dos crimes ambientais. Metodologia: Os presentes dados foram coletados por meio de uma pesquisa bibliográfica em artigos científicos, livros, e sites relacionados diretamente com o tema abordado, principalmente os sites dos órgãos que tratam da gestão do meio ambiente como, IBAMA, MINISTÉRIO DO MEIO AMBIENTE, bem como à legislação pátria. Resultados: O que se observa em comum dentre os dados coletados e o objetivo do trabalho é que a eficácia da legislação dos crimes ambientais é fraca e está longe de ser eficaz, porque falta fiscalização efetiva e educação ambiental, para que se possa desfrutar do meio ambiente sem prejudicá-lo, garantindo assim sobrevivência e o equilíbrio natural entre as espécies e o meio ambiente, para as presentes e futuras gerações. Conclusão: É possível notar que existem dois grandes problemas, o tráfico de animais silvestres e a prática de biopirataria, problemas que são decorrentes da falta de eficácia da legislação ambiental que norteia e conduz os crimes que são constantes e muitas das vezes tratados com menor importância pelos aplicadores da lei. O alcance da legislação é mínimo se comparado com o tamanho do país e o potencial dos crimes que são praticados contra a fauna e a flora, tal fato faz com que a legislação não seja eficaz em sua aplicação. | en_US |
