| dc.description.abstract | A presente monografia trata-se da diferenciação da figura do usuário para o traficante de drogas, para tanto, inicia-se com um contexto histórico, que retrata o caminho percorrido até a promulgação da Lei 11.343/06. Sequentemente, busca uma definição daquilo conhecido como droga, bem como, suas causas, efeitos e consequências, além de fazer uma breve distinção entre aquelas consideradas lícitas e, às ilícitas. Objetivo: Busca, por meio de uma análise nos ordenamentos jurídicos próprios, bem como, na doutrina e jurisprudência, conceituar a figura do usuário e do traficante de drogas, tal qual, os fatores que distinguem os mesmos. Metodologia: A presente pesquisa destina-se, em apresentar os critérios legais e jurisprudências, que diferenciam o usuário do traficante de drogas, além de apontar a impossibilidade de uma decisão, clara e objetiva, por se tratar de uma norma penal em branco. Resultado: A hipótese inicial é a problemática causada por uma norma penal em branca, que possibilita decisões embasadas no próprio entendimento do órgão julgador, possibilitando uma seletividade penal, incompatível com uma justiça imparcial e ponderada. Conclusão: Aqui, foi tratado, de maneira exacerbada, a impossibilidade de diferenciar, a droga para consumo próprio, daquela destinada a comercialização, tendo como única fundamentação, a quantidade da mesma, tendo como base, julgados e entendimentos jurisprudenciais. | en_US |
| dc.description.edition | This monograph is about the differentiation of the user figure from the drug dealer, therefore, it starts with a historical context, which portrays the path taken until the enactment of Law 11.343/06. Subsequently, it seeks a definition of what is known as a drug, as well as its causes, effects and consequences, in addition to making a brief distinction between those considered legal and illegal ones. Objective: Searches, through an analysis in the legal systems, as well as in the doctrine and jurisprudence, to conceptualize the figure of the drug user and dealer, as well as the factors that distinguish them. Methodology: This research aims to present the legal criteria and jurisprudence, which differentiate the user from the drug dealer, in addition to pointing out the impossibility of a clear and objective decision, as it is a blank criminal rule. Result: The initial hypothesis is the problem caused by a blank penal rule, which allows decisions based on the judging body's own understanding, enabling penal selectivity, incompatible with impartial and balanced justice. Conclusion: Here, the impossibility of differentiating the drug for own consumption from that intended for commercialization was treated, in an exacerbated way, having as its only reasoning, the quantity of it, having as basis, judgments and jurisprudential understandings. | en_US |
