| dc.description.abstract | De maneira geral, o estudo da alienação parental atrelado ao estudo da guarda perpassa, necessariamente, através do estudo das famílias. É impossível não tratar dos temas referentes à pessoa dos filhos sem, antes, percorrer o extenso cenário jurídico da instituição da família. E, atrelado a isso, a investigação que se faz na seara de infância e juventude é condição sem a qual a pesquisa mostra-se ineficiente ao interesse científico. Objetivo: A presente pesquisa traz consigo importantes destaques, através dos quais se pode compreender que o modelo de guarda unilateral é capaz de fragilizar a convivência entre pais e filhos, na medida em que possibilita o afastamento gradual e a ruptura dos laços. Conclusão: Dessa forma, no distanciamento natural, os filhos estão sujeitos às práticas de alienação parental, pois o genitor-alvo dos ataques pode não ter tempo suficiente para demonstrar à prole que as memórias implantadas são falsas, culminando assim em extenso ódio, rancor, insegurança e medo por parte da criança ou do adolescente. Assim, entende-se que a guarda compartilhada é capaz de amenizar e afastar tais práticas e efeitos danosos. Metodologia: Para tanto, utiliza-se metodologia de pesquisa bibliográfica, cujo método é o exploratório, através de leituras e fichamentos de doutrina, jurisprudências e artigos acadêmicos. | en_US |
| dc.description.edition | In general, the study of parental alienation linked to the study of custody runs, necessarily, through the study of families. It is impossible not to deal with issues related to the person of the children without, first, going through the extensive legal scenario of the institution of the family. And, linked to this, the research that is done in the field of childhood and youth is a condition without which research is inefficient for scientific interest. Objective: This research brings with it important highlights, through which it can be understood that the model of unilateral custody is capable of weakening the coexistence between parents and children, as it allows the gradual removal and the breaking of ties. Conclusion: Thus, in the natural distance, the children are subject to the practices of parental alienation, because the target parent of the attacks may not have enough time to demonstrate to the offspring that the implanted memories are false, thus culminating in extensive hatred, resentment, insecurity and fear on the part of the child or adolescent. Thus, it is understood that shared custody is able to mitigate and ward off such harmful practices and effects. Methodology: For this, bibliographic research methodology is used, whose method is exploratory, through readings and records of doctrine, jurisprudence and academic articles. | en_US |
