ANÁLISE DA LEI N. 13.769/2018 COM ÊNFASE NAS SUBSTITUIÇÕES DAS PRISÕES E OS IMPACTOS CAUSADOS NO DESENVOLVIMENTO DO INFANTE

| dc.description.abstract | Introdução: Apresenta um estudo sobre os problemas enfrentados pelas mulheres privadas de liberdade e os impactos que a privação de liberdade causam para o desenvolvimento do menor. Objetivo: analisar a Lei 13.769/2018 buscando aferir as possibilidades de substituição da prisão preventiva em prisão domiciliar, bem como examinar os reflexos que a maternidade no cárcere ocasiona no desenvolvimento do infante. Para isso, será analisado os direitos e garantias fundamentais indispensáveis para o crescimento desta criança, priorizando o direito ao convívio familiar, em especial, com sua progenitora. Contudo, abordará também a inadequação dos presídios para atender as necessidades maternas e infantis, assim como buscará medidas alternativas à prisão para beneficiar a manutenção do poder familiar e, consequentemente, o desenvolvimento físico e psíquico destas crianças. Metodologia: trata-se de uma pesquisa do tipo explicativa, utilizando-se como meio a pesquisa bibliográfica, que por fim terá uma abordagem qualitativa. Resultados: foi realizado um estudo das principais leis que ensejaram medidas desencarceradoras afim de estabelecer uma maior aproximação dos presos às suas famílias, assim como os Habeas Corpus 151.057/DF e 143.641/ SP que desencadearam a promulgação da Lei 13.769/18, resultando em divergências jurisprudenciais, nos quais a grande maioria dos pedidos de substituição ainda são indeferidos pelos tribunais. Conclusão: Por fim, o trabalho abordará a aplicação da Lei 13.769/2018 nos dias atuais por meio de estudos jurisprudenciais, analisando as melhores medidas em benefício do menor. Conclui-se, portanto, a imprescindibilidade das razões humanitárias que justifiquem o abrandamento do tratamento penal destas mulheres, permitindo uma aproximação maior dos laços familiares, especialmente, o convívio com seus filhos. | en_US |
| dc.description.edition | Introduction: This research study has revealed about the prision maternity and the impacts that prison has on child development. Objective: This monograph aims to analyze Law 13.769/2018 seeking to assess as possibilities of replacement of pre-trial detention to house arrest, as well as to examine the consequences of motherhood and how it occurs during infant development. To this end, the fundamental rights and guarantees that are essential for the growth of this child will be analyzed, prioritizing the right to family life, especially with their mother It will also address the inadequacy of prisons to meet maternal and child needs, as well as to seek alternative measures to both precautionary and definitive arrest to benefit the maintenance of family power and, consequently, the physical and mental development of these children. Methodology: it is an explanatory research, using as a means the bibliographical research, will have a qualitative approach. Research results: For this reason, the study of the main laws that lead to trigger measures will be carried out in order to establish a closer proximity of prisoners to their families, as well as Habeas Corpus 151.057/DF and 143.641/SP which triggered the promulgation of this Law, which most of the replacement requests were rejected by the courts. Conclusion: Finally, this work will address the application of Law 13.769/2018 on current days through case law studies, analyzing the best measures for the benefit of the underage person. Furthermore, this paper concludes the absolute necessity of human reasons that justify the dimishing of the penal treatment of these women, permitting a bigger proximity between family links, especially, contact with their children. | en_US |
