| dc.description.abstract | Estudar o instituto da cadeia de custodia, apresentando ao final uma análise pratica. Objetivo: Esta monografia tem o objetivo de analisar o instituto da Cadeia de Custodia da prova no âmbito do processo penal, trazendo a analise os novos artigos incluídos pela lei 13.964/2019 conhecida como pacote anticrime. Dando enfoque há prova pericial que é meritório para o livre convencimento do magistrado, que deverá sempre fundamentar sua decisão evitando que ilicitudes aconteçam. Metodologia: Portanto, foi necessário a criação de um instituto para proteger e garantir a autenticidade dessas provas em todas as suas fases, este instituto é a Cadeia de Custodia da Prova. Busca interpretar e mostrar ao público as diretrizes de implantação da Cadeia de Custodia criadas pelos órgãos competentes da Policia Civil e por fim vem mostrar na prática como foi feito o procedimento de implantação na cidade de Lavras - MG. Resultados: O programa foi muito bem elaborado e apresentou êxito desde sua primeira inserção. Nele está sendo possível monitorar todo o caminho cronológico da prova e manter sua integridade. Conclusão: Em primeira visão pode-se entender que o inicio da cadeia de custodia é quando o vestígio é inserido no programada e destinado a sala reservada para sua guarda, mas não é. A cadeia de custodia começa desde quando se tem o primeiro contato com o vestígio, ou seja, desde o reconhecimento do vestígio e não quando inserido fisicamente dentro da sala reservada a unidade custodiada. | en_US |

Objective: This monograph aims to analyze the Chain of Custody institute of evidence in the context of criminal proceedings, bringing to the analysis the new articles included by law 13.964/2019, known as the anti-crime package. Focusing there is expert evidence that is meritorious for the free conviction of the magistrate, who must always base his decision preventing illegalities from happening. Methodology: Therefore, it was necessary to create an institute to protect and guarantee the authenticity of these evidence in all its phases, this institute is the Chain of Custody of the Evidence. It seeks to interpret and show the public the guidelines for the implementation of the Chain of Custody created by Organs competent bodies of the Civil Police and finally comes to show in practice how the implementation procedure was carried out in the city of Lavras - MG. Results: The program was very well designed and was successful since its first insertion. It is possible to monitor the entire chronological path of the test and maintain its integrity. Conclusion: At first glance it can be understood that the beginning of the chain of custody is when the trace is inserted in the programmed and destined to the room reserved for its custody, but it is not. The chain of custody starts from the moment you have the first contact with the trace, that is, from the recognition of the trace and not when it is physically inserted into the room reserved for the unit in custody. | en_US |
