| dc.description.abstract | Constitui um estudo sobre o reconhecimento da paternidade, sobre o dano moral e a possibilidade da aplicação da indenização por dano moral destinada ao investigante nos casos em que, por omissão do genitor, o filho precisa buscar o seu reconhecimento por meio da ação de investigação paternidade. Objetivo: Analisar o ordenamento jurídico, doutrinas, entendimentos e jurisprudência acerca do dano moral e a possibilidade de sua aplicação na ação de investigação de paternidade, quando se tem o reconhecimento formal. Metodologia: Apresenta como finalidade a pesquisa explicativa, tendo como meio de investigação a pesquisa bibliográfica com abordagem qualitativa. Conclusão: O presente estudo permitiu a conclusão de que o dano moral causado no filho pela ausência da figura paterna em não o reconhecer é inegável. A omissão do genitor em não reconhecer um filho configura negligência de sua parte, o que, sob a ótica da responsabilidade civil, caracteriza a conduta do agente. Assim, diante dessa omissão, concebe-se a ideia de uma conduta capaz de gerar danos no filho, danos estes que necessitam de reparação. A ausência da figura paterna no crescimento e desenvolvimento de uma criança e/ou adolescente pode gerar danos de esfera emocional e psicológica, ou seja, extrapolam os danos apenas da esfera patrimonial. A aplicabilidade do dano moral, neste caso, seria uma forma de reparar, minimamente, a dor e os abalos sofridos pelo investigante. Dessa forma, demonstrado o ato ilícito pelo ato omissivo e negligente do genitor, abre-se a possibilidade e necessidade da aplicação do dano moral ao filho. A incidência dessa indenização por dano moral ao pai, portanto, possui o intuito de compensar as perturbações e sentimentos sofridos, como também desestimular novas condutas similares do pai. | en_US |
| dc.description.edition | I did research on the acknowledgement of paternity, on moral damage and the possibility of applying indemnification for moral damages intended for the investigator in cases that, by the parents’ omission, the son needs to seek his or her recognition through paternity investigation. Goals: analyze the legal system, doctrines, understandings and jurisprudence concerning the moral damage and the possibility of its application in the action of paternity investigation, when one has the formal recognition. Methodology:it presents as a purpose of explanatory research, having as a means of investigation the bibliographic research with qualitative approach. Conclusion: The present study allowed the conclusion that the moral damage caused in the child by the absence of the father figure in not recognizing him or her is undeniable. The father`s omission in not recognizing a child constitutes negligence on his part, which, from the standpoint of civil responsibility, characterizes the conduct of the agent. Thus, in the face of this omission, the idea of this conduct being capable of generating damage to the child is conceived, and it needs to be repaired. The absence of the paternal figure in the growth and development of a child or adolescent can generate emotional and psychological damages, that is, they extrapolate the damages only from the patrimonial sphere. The applicability of the moral damage, in this case, would be a way to repair, minimally, the pain and shakes suffered by the investigator. Thus, demonstrating the illicit act by the omissive and negligent act of the parent, it opens the possibility and necessity of applying moral damages to the child. The incidence of this indemnity for moral damages to the father, therefore, has the intention of compensating for the disturbances and feelings suffered, as well as discouraging new similar conducts of the father. | en_US |
