| dc.description.abstract | O assédio moral tem sua origem devido a incansável corrida cada vez mais desenfreada pelo sucesso e o lucro, sendo os trabalhadores submetidos a competições agressivas e até opressão através da ameaça e do medo, em profundo desrespeito ao princípio constitucional da dignidade humana. Objetivo: O trabalho em questão pretende observar a evolução do instituto de forma geral e principalmente no Brasil, dando enfoque a aspectos históricos, conceituais e legais que envolvem o assunto. Buscando, caracterizar o assédio, bem como diferenciá-lo de outros institutos, e ainda, relacioná-lo com o princípio constitucional da dignidade humana. Metodologia: Tem, inicialmente, a pesquisa qualitativa, onde se usa um método de investigação científica que se foca no caráter subjetivo do objeto analisado, os quais são explorados por meio de dados, fatos, que foram coletados através de revisões bibliográficas. A pesquisa será realizada em bibliotecas físicas e virtuais, sendo selecionadas as jurisprudências e as legislações em vigor, inclusive, por meio eletrônico na rede internacional de internet. Conclusão: As cortes brasileiras tem entendido pela responsabilização do empregador aos danos causados pelo assédio moral ao trabalhador, ao passo em que a prática de tais atos ofensivos são considerados como uma afronta considerável ao princípio da dignidade da pessoa humana. Assim, o tratamento considerado urbano e respeito é uma questão de dever e não somente questão de legalidade, vez que esses elementos devem estar presentes dentro da relação contratual trabalhista. | en_US |
| dc.description.edition | Moral harassment has its origin due to a relentless race that is increasingly rampant for success and profit, with workers being subjected to aggressive competition and even oppression through threat and fear, in profound disrespect for the constitutional principle of human dignity. Objective: The work in question intends to observe the evolution of the institute in general and mainly in Brazil, focusing on historical, conceptual and legal aspects that involve the subject. Seeking to characterize harassment, as well as differentiate it from other institutes, and also, relate it to the constitutional principle of human dignity. Methodology: Initially, there is qualitative research, where a method of scientific investigation is used that focuses on the subjective character of the analyzed object, which are explored through data, facts, which were collected through bibliographic reviews. The research will be carried out in physical and virtual libraries, with case law and legislation in force being selected, including by electronic means on the international internet network. Conclusion: The Brazilian courts have understood the responsibility of the employer for the damages caused by moral harassment to the worker, whereas the practice of such offensive acts is considered as a considerable affront to the principle of human dignity. Thus, the treatment considered urban and respect is a matter of duty and not just a question of legality, since these elements must be present within the labor contractual relationship. | en_US |
