ANÁLISE DA LEGITIMIDADE DA POLÍCIA MILITAR DO ESTADO DE MINAS GERAIS PARA LAVRAR O TERMO CIRCUNSTANCIADO DE OCORRÊNCIA

dc.description.abstract | fazer um profunda análise dos institutos da Lei 9.099/95, da Jurisprudência e da doutrina, a fim de verificar se os integrantes da Polícia Militar do Estado de Minas Gerais são autoridades policiais competentes para lavrar o Termo Circunstanciado de Ocorrência (TCO). Metodologia: Os presentes dados foram coletados por meio de uma pesquisa bibliográfica em artigos científicos, livros, Jurisprudência dos Tribunais Estadual e do STF e, ainda, em sites relacionados diretamente com o tema abordado. Resultados: O cerne da discussão envolve a Lei Estadual nº. 22.247/16, de 22 de julho de 2016, que em seu artigo 191 permitiu que o Termo Circunstanciado de Ocorrência, até então lavrado apenas pela Polícia Civil, através dos Delegados de Polícia, também pudessem ser lavrados pelos integrantes da Polícia Militar e pelo Corpo de Bombeiro Militar no Estado de Minas Gerais. Todavia, a Associação dos Delegados do Brasil ajuizou uma Ação Direta de Inconstitucionalidade – ADI nº. 5627, alegando a inconstitucionalidade do artigo 191 da respectiva legislação estadual e a ilegitimidade da Polícia Militar para lavrar o TCO. A doutrina e a jurisprudência pesquisada divergem sobre o tema, de modo que ainda não há decisão unânime sobre o tema. Conclusão: Apesar da falta de clareza do art. 69 da Lei 9.099/95 ao tratar da autoridade policial competente para lavrar o TCO, da incongruência de posicionamentos da doutrina e da jurisprudência sobre o tema, e, ainda, considerando os princípios norteadores da Lei 9.099/95, atrelado ao dever de eficiência da administração pública, bem como, a existência de norma legal em pleno vigor que autoriza policias e bombeiros militares lavrar o TCO em MG, por hora, até que o STF de manifeste de forma definitiva sobre o assunto, somos forçosos a concluir que em Minas Gerais os integrantes da Policia Militar são competentes para lavrar o TCO. | en_US |
dc.description.edition | This study presents an analysis on the legitimacy of the members of the Military Police of the State of Minas Gerais to make the Detailed Occurrence Term provided for in article 69 of the Law 9.099/95. Objectives: Make an in-depth analysis of the institutes of Law 9.099/95, jurisprudence and doctrine, in order to verify if the members of the Military Police of the State of Minas Gerais are police authorities competent to draw up the Detailed Occurrence Term (TCO). Methodology: The present data were collected through a bibliographic research in scientific articles, books, jurisprudence of the State Courts and the Supreme Court and, still, in sites directly related to the theme addressed. Results: The heart of the discussion involves the State Law no. 22.247/16, of 22 July 2016, which in its article 191 allowed the detailed Term of Occurrence, until then only issued by the Civil Police, through the Police Officer, could also be worked by members of the Military Police and the Military Fire Department in the State of Minas Gerais. However, the Association of Delegates of Brazil filed a direct action of unconstitutionality – ADI nº. 5627, alleging the unconstitutionality of Article 191 of the respective state legislation and the illegitimacy of the Military Police to draw up the TCO. The doctrine and jurisprudence researched diverge on the subject, so that there is still no unanimous decision on the subject. Conclusion: Despite the lack of clarity of art. 69 of Law 9.099/95 when dealing with the police authority competent to draw up the TCO, the inconsistency of positions of the doctrine and the jurisprudence on the subject, and also considering the guiding principles of Law 9.099/95, coupled with the duty of efficiency of the public administration, as well, the existence of legal standard in full force authorizing Police and Military Firefighters to draw up the TCO in MG, per hour, until the Supreme Court manifests definitively on the subject, we must conclude that in Minas Gerais the members of the Military Police are competent to draw up the TCO. | en_US |
