| dc.description.abstract | Com o intuito de trazer uma reflexão cientifica e jurídica a respeito do Serial killer, (assassino em série, em tradução livre), que são criminosos que matam por prazer, frequentemente com algum intervalo de tempo, podendo ser dias ou anos. Sendo estes considerados com personalidade psicopática e /ou sociopata e também portadores de doença mental grave, os psicóticos. Com o propósito de trazer um alerta a respeito do mesmo e a sua periculosidade. Abordando não somente sua definição, como também a distinção entre serial killer psicopatas e/ou sociopatas e serial killers psicóticos. Objetivos: Ante o exposto, propõe-se em analisar o serial killer no Brasil com base em uma retrospectiva geral de alguns casos registrados em solo brasileiro durante duzentos e vinte anos. Metodologia: Utilizando-se de pesquisa bibliográfica por meio de livros, revista jurídicas, artigos científicos, doutrinas, bem como a legislação nacional e internacional afim de observar a necessidade de se ter uma tipificação no código penal com definição e métodos de tratamento para esse indivíduo cuja sanção penal brasileira e as medidas de segurança são ineficazes para se alcançar justiça. Conclusão: Por fim uma análise crítica de um único projeto de lei relacionado ao seria killer comparando seus métodos de tratamento e definição com casos americanos, a luz de escritores como John Douglas, Mark Olshaker, Ilana Casoy, Robert Hare e Harold Schechter. | en_US |
