| dc.description.abstract | Apresenta um estudo sobre o Acordo de Não Persecução Penal e aborda algumas questões que surgiram com seu advento. Objetivo: Analisa se o Acordo de Não Persecução Penal consiste em um direito subjetivo do investigado, bem como se o requisito da confissão exigida na celebração pode ou não ferir o direito ao silêncio previsto na Constituição Federal de 1988. Metodologia: O trabalho se constituiu em pesquisas bibliográficas, jurisprudencial e legislação. Conclusão: Conclui-se que o Acordo de Não Persecução Penal é um acordo bilateral que busca resolver conflitos de forma consensual mais célere e eficaz, mediante cumprimento de algumas condições a serem impostas pelo Ministério Público, sendo que cumpridas as condições, o juiz decretará a extinção da punibilidade. Deste modo, uma das conclusões principais, refere-se à exigência da confissão para a realização do acordo, se o mesmo poderia ferir o direito ao silêncio, considerando que tanto a realização do acordo, quanto o exercício do direito ao silêncio são facultativos, verifica-se que a confissão exigida não fere esse direito. Ademais, conclui-se que se trata de negócio jurídico, onde o Ministério Público tem a discricionariedade e a faculdade de oferecer o acordo, desde que seja suficiente para a reprovação e prevenção do crime. | en_US |
| dc.description.edition | It presents a study on the Non-Prosecution Agreement and addresses some issues that arose with its advent. Objective: Analyzes whether the Non-Persecution Agreement consists of a subjective right of the investigated, as well as whether the requirement of confession required in the celebration may or may not violate the right to silence provided for in the Federal Constitution of 1988. Methodology: This thesis was constituted in bibliographic research, jurisprudence and legislation. Conclusion: It is concluded that the Non-Persecution Agreement is a bilateral agreement that seeks to resolve conflicts in a faster and more effective consensual way, by complying with some conditions to be imposed by the Public Prosecutor's Office, and if the conditions are met, the judge will decree the extinction of punishment. Thus, one of the main conclusions refers to the requirement of confession for the realization of the agreement, if it could violate the right to silence, considering that both the realization of the agreement and the exercise of the right to silence are optional, it is verified that the required confession does not infringe on that right. In addition, it is concluded that it is a legal transaction, where the Public Ministry has the discretion and the faculty to offer the agreement, as long as it is sufficient for the reprobation and prevention of the crime. | en_US |
