| dc.description.abstract | A fidelidade é tida como um dos deveres conjugais. A instituição da família é uma das que mais sofre alterações com o decorrer do tempo e com sua evolução foi tomando novas formas, sendo uma delas a poliafetiva, em que pese ser é um arranjo social compost o de três ou mais pessoas, que em nome do poliamor e a busca pela felicidade vem se estabelecendo no seio da sociedade com a finalidade precípua de compor uma família, tornando, ao menos aos olhos do meio em se insere mais uma entidade familiar. Objetivo: Por conseguinte, frente a essa nova modulação, o presente trabalho tem por objetivo trazer como se o papel da fidelidade nessas relações e suas consequências, como por exemplo, na esfera civil, uma vez que mesmo não condizendo com a regra mencionada os env olvidos não podem sofrer penalizações pelos simples direito de amar. Metodologia: Através da revisão bibliográfica de livros, artigos científicos, revistas e outras fontes mediatas e imediatas do direito, procurou entender essa nova modalidade de família. Conclusão: Ao analisar essas relações, foi possível constatar que são nada mais do que um arranjo já conhecido pela sociedade, mas que só agora está ganhando notoriedade e que não violam o dever da fidelidade imposto ao casamento. Conclui se, portanto, que essas famílias merecem a proteção estatal, visto que não existe uma justificativa que ampare a discriminação entre relações poliafetivas e relações monogâmicas. | en_US |

The institution of the family is one of the ones that suffers more changes with the course of time and with its evolution has been taking new forms, one of them being the polyfective, in which despite being a social arrangement composed of three or more people, that in the name of the polyamor and the search for happiness has been establishing itself in the bosom of the society with the main purpose of composing a family, becoming, at lea st in the eyes of the environment, one more family entity. Objective: Therefore, in face of this new modulation, the present work aims to bring as if the role of fidelity in these relations and its consequences, as for example, in the civil sphere, since e ven if not in accordance with the mentioned rule those involved cannot suffer penalties for the simple right to love. Methodology : Through the bibliographic review of books, scientific articles, journals and other mediated and immediate sources of the law, it sought to understand this new family modality. Conclusion: By analyzing these relationships, it was possible to see that they are nothing more than an arrangement already known to society, but that it is only now gaining notoriety and that they do not violate the duty of fidelity imposed on marriage. It is concluded, therefore, that these families deserve state protection, since there is no justification to support the discrimination between poly affective relations and monogamous relations. | en_US |
