| dc.description.abstract | Introdução: O presente trabalho tem como objeto de estudo a Lei 12.850/2013 que tem como foco a delação premiada, que de modo demonstre o objetivo, efetividade e problemas que ela pode solucionar no nosso ordenamento jurídico, Sendo que a delação é uma ferramenta utilizada pelo Estado para resolver de forma mais eficaz os crimes. Entretanto cuidados devem ser tomados na forma de utilização não afrontando as garantias individuais do asseguradas pela Constituição Federal e pelo Ordenamento Jurídico. Objetivo: O que se pretende com o presente trabalho, em sentido amplo, é demonstrar a aplicação da delação premiada, podendo o delator ter alguns benefícios por ter delatado outras pessoas que cometeram o ato ilícito. Metodologia: Os presentes dados foram coletados por meio de uma pesquisa bibliográfica em artigos científicos, livros, e sites relacionados diretamente com o tema abordado, sobre o tema delação premiada Lei 12.850/2013. Resultado: A delação premiada tem como finalidade dar um privilégio ou gratificação pelo ato de contar o ocorrido os crimes objeto de investigação para ajudar a solucionar. Conclusão: Após analise à doutrina e jurisprudência, em síntese, a delação premiada, demonstra ser eficaz no combate ao crime organizado. Com esse instituto pode-se conseguir redução de sua pena que será fixada, mas muito raro o perdão judicial. | en_US |
