| dc.description.abstract | Os crimes sexuais na maioria das vezes acontecem na clandestinidade, longe de testemunhas, e ainda, não deixam vestígios. Desta forma, o magistrado dá uma maior importância à palavra da vítima, presumindo-se como verdade o seu depoimento. Pois bem, diante da fragilidade das provas, nem sempre a vítima age de boa-fé, e por muitas vezes, por raiva do suposto autor, o denuncia como seu estuprador, podendo gerar uma condenação embasada em fatos inverídicos. Objetivo: Analisar o assunto proposto sobre o valor da palavra da vítima nos crimes de estupro em seus aspectos jurisprudenciais e possíveis riscos e danos ao acusado. Metodologia: A metodologia a ser aplicada é sobre o método dedutivo, em que busca alcançar a finalidade desejada através do presente estudo, mediante estudo intensivo em doutrinas essenciais de Direito Penal, Direito Processual Penal, bem como sobre legislações e jurisprudências. Com relação à abordagem, o presente trabalho adota o modelo qualitativo, buscando a compreensão de informações sob ampla forma. Conclusão: há de se extrair que a palavra da vítima como meio de prova isolada nos crimes contra a dignidade sexual, não é o suficiente para sustentar uma condenação, cabendo no mínimo estar amparada por outro tipo de prova, sob pena de ofensa aos princípios da prevalência do interesse do réu e também do princípio da inocência. | en_US |

In this way, the magistrate gives greater importance to the victim's word, assuming her testimony as true. Well, given the fragility of the evidence, the victim does not always act in good faith, and many times, out of anger at the alleged perpetrator, he denounces him as his rapist, which may lead to a conviction based on untrue facts. Objective: To analyze the proposed subject on the value of the victim's word in rape crimes in its jurisprudential aspects and possible risks and damages to the accused. Methodology: The methodology to be applied is on the deductive method, which seeks to achieve the desired purpose through this study, through intensive study of essential doctrines of Criminal Law, Criminal Procedure Law, as well as on legislation and jurisprudence. Regarding the approach, the present work adopts the qualitative model, seeking to understand information in a broad form. Conclusion: it must be extracted that the victim's word as a means of isolated evidence in crimes against sexual dignity is not enough to sustain a conviction, and at least it should be supported by another type of evidence, under penalty of offending the principles of prevalence of the defendant's interest and also of the principle of innocence. | en_US |
